1. About us

This website is operated by The Cornwall Stork Project, a charity registered in England and Wales (charity number 1211474). In these terms, "we", "us" and "our" refer to The Cornwall Stork Project. "You" and "your" refer to anyone who accesses or uses the site.

2. Acceptance of these terms

By accessing or using this site you agree to these terms and our privacy notice. If you do not agree, please stop using the site. We may update these terms from time to time. Material changes will be flagged on the homepage for at least 14 days. The date at the top of this page tells you when it was last updated.

3. Acceptable use

You agree not to:

  • use the site in any way that breaks UK law or any applicable regulation,
  • submit false, misleading or fraudulent sightings, donations, volunteer applications or contact messages,
  • upload or transmit any material that is unlawful, defamatory, obscene, harassing, infringing, or harmful to children or wildlife,
  • attempt to gain unauthorised access to the site, its server, or any connected database, or interfere with its security,
  • scrape, harvest or otherwise extract data from the site at scale without our written permission,
  • introduce viruses, malware, or any other harmful code,
  • impersonate any person or misrepresent your affiliation with us, our partners, or any other organisation.

We reserve the right to remove content, suspend accounts, refuse service, and report serious breaches to the relevant authorities.

4. Donations

Donations are processed by Stripe. By donating you confirm that the funds are your own (or that you are authorised to donate them) and that the payment method belongs to you.

All donations are non-refundable except where required by law, or in exceptional circumstances at our discretion (for example a clear input error or duplicate transaction). To request a refund please contact us within 14 days of the donation.

Where you make a Gift Aid declaration, you confirm you are a UK taxpayer and that you understand we will reclaim 25p of tax on every £1 you give. You are responsible for telling us if your circumstances change. HMRC may require us to share Gift Aid records with them.

Donations support the charitable objects of The Cornwall Stork Project. We do our best to honour the spirit of any restricted appeal, but we may need to redirect funds to similar charitable activity if an appeal cannot be carried out as planned, in line with Charity Commission guidance.

5. Sighting submissions

When you submit a sighting (including any photographs, notes or location data) you confirm that:

  • the information is true to the best of your knowledge,
  • you took any photographs you upload, or you have permission to share them,
  • you have permission from anyone identifiable in the photographs,
  • you respected access rights, the Countryside Code, and any private land.

By submitting a sighting you grant us a worldwide, non-exclusive, royalty-free, perpetual licence to use, reproduce, adapt and publish the submission for charitable, conservation, educational and fundraising purposes, including on this website, in newsletters, in reports, and on social media. We will credit you by the name you provide where reasonably practicable. You retain copyright in your photographs.

We may edit, anonymise, redact location detail, decline or remove any submission. Approved sightings may be retained as part of the long-term conservation record.

6. Volunteering

Submitting a volunteer application is an expression of interest, not a contract of employment or a binding offer on either side. Any volunteering you go on to do for us is subject to our volunteer policies, including safeguarding, health and safety, and (where relevant) DBS checks. We reserve the right to decline or end any volunteering arrangement.

7. Intellectual property

The site, its design, code, text, photographs, logos, maps and other content (other than user submissions and third-party material) are owned by us or our licensors and are protected by copyright, trade mark and database rights.

You may view, download and print pages from the site for your own personal, non-commercial use, and share links to the site. You may not otherwise copy, republish, sell, exploit or systematically extract content from the site without our prior written permission.

"The Cornwall Stork Project" and our logo are unregistered trade marks of the charity. Partner logos are the property of their respective owners and are used with permission.

8. Third-party content and links

The site may link to third-party websites (such as our partners, payment provider, or scientific resources). We do not control those sites and are not responsible for their content, availability, or privacy practices. Following any link is at your own risk.

9. Wildlife and field-visit disclaimer

The information on this site about storks, sites and wildlife is provided for general interest and education. White Storks are a wild species and we cannot guarantee sightings at any location. If you visit a site featured on the map or in our content:

  • respect private land and seek the landowner's permission where required,
  • follow the Countryside Code,
  • do not approach nests, chicks, or roosting birds,
  • keep dogs under close control,
  • take responsibility for your own safety and that of those with you.

We accept no liability for any loss, injury or damage suffered as a result of acting on information published on this site.

10. Disclaimers and limitation of liability

We do our best to keep the site accurate and up to date, but we provide it on an "as is" and "as available" basis and make no warranties, express or implied, including as to accuracy, completeness, fitness for a particular purpose, or uninterrupted availability.

To the fullest extent permitted by law, we and our trustees, employees, volunteers and partners are not liable for any indirect, incidental, special or consequential loss, or for any loss of profit, revenue, goodwill, data, or anticipated savings, arising from your use of (or inability to use) the site.

Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be limited or excluded under English law.

If you are using the site as a consumer, your statutory rights are not affected.

11. Suspension and termination

We may suspend, restrict or end your access to all or part of the site at any time, without notice, if we reasonably believe you have breached these terms or where we are required to do so by law.

12. Governing law and jurisdiction

These terms, and any dispute or claim arising out of or in connection with them or the site, are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction, save that if you are a consumer resident in Scotland or Northern Ireland you may also bring proceedings in your local courts.

13. Contact and complaints

If you have a question or complaint about the site, our fundraising, or anything else, please contact us first at info@thecornwallstorkproject.org. We aim to acknowledge complaints within 5 working days and respond fully within 28 days.

If you are not satisfied with our response to a fundraising complaint, you can escalate to the Fundraising Regulator. Concerns about how a charity is run can be raised with the Charity Commission for England and Wales.

These terms have been prepared in good faith for review by the trustees before launch. Replace the contact email and registered charity details with the charity's confirmed information before publishing.
